Terms of Service for Vatalia, Inc.
1. Introduction
Welcome to Vatalia. These Terms of Service ("Terms") govern your access to and use of our website vatalia.com (the "Site") and the purchase of Living Art and related products. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site.
2. Eligibility
You must be at least 18 years old to use our Site and purchase products. By using our Site, you represent and warrant that you meet this age requirement.
3. Account Registration
To make a purchase or reserve Living Art, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please ensure that the information you provide is accurate and current.
4. Product Information and Pricing
We strive to provide accurate descriptions and pricing for our Living Art systems, Canvases, and botanical collections. However, errors may occur. If we discover a pricing or product description error, we reserve the right to correct it and update your order accordingly, or to cancel the order and issue a full refund.
5. Reservations and Payment
Reservation Process: You may reserve Living Art with a $1 deposit, which secures your place in our founding collection. Full payment will be required prior to delivery, scheduled for early 2026.
Payment Terms: By placing an order, you agree to pay the specified price for your Living Art, Canvases, seed collections, and any applicable shipping costs and taxes. We accept payment methods as indicated on our Site. Full payment must be received before your order ships.
6. Shipping and Delivery
We will coordinate the shipment and delivery of your Living Art directly with you. Delivery timelines are estimates and may be adjusted as needed. We will keep you informed throughout the process. We are not liable for delays caused by shipping carriers or circumstances beyond our control.
7. Returns and Refunds
Please refer to our Refund and Exchange Policy for complete information on returns, exchanges, and refunds. This policy is incorporated into these Terms by reference.
8. Intellectual Property
All content on our Site—including text, graphics, logos, images, photographs of our Living Art systems, Canvas designs, and software—is the property of Vatalia or our content partners and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.
9. User Conduct
You agree to use our Site only for lawful purposes and in a manner that does not harm others. Prohibited activities include:
- Violating any applicable laws or regulations
- Infringing upon the intellectual property or other rights of Vatalia or third parties
- Uploading or transmitting viruses, malicious code, or harmful materials
- Engaging in fraudulent, deceptive, or abusive practices
- Attempting to gain unauthorized access to our systems or user accounts
10. Limitation of Liability
To the fullest extent permitted by law, Vatalia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the product in question.

You agree to indemnify and hold harmless Vatalia and its affiliates, officers, employees, and partners from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.
